TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter “Terms”) govern the contractual relationship arising from the purchase of products offered on www.palauantiguitats.com, in accordance with Spanish Royal Legislative Decree 1/2007 of 16 November (consolidated text of the General Consumer and User Protection Act — TRLGDCU), Law 34/2002 (LSSICE) and Directive (EU) 2019/2161 (Omnibus Directive), transposed into Spanish law.

1. PARTIES TO THE CONTRACT

Seller: Palau Antiguitats S.C.P., C/ Gràcia, 1 – BJ, 08012 Barcelona, Spain, info@palauantiguitats.com.

Buyer: any natural or legal person placing an order through the website.

2. PRODUCTS AND AVAILABILITY

All products offered are original works of art and antiques, described in detail on each product page, including authorship, period, technique, dimensions and condition.

Given the unique nature of each piece, availability is subject to order confirmation. The owner reserves the right to remove any product from the catalogue without prior notice.

3. PURCHASE PROCESS

  • The user selects items and adds them to the shopping cart.
  • The user reviews the order, enters delivery details and selects a payment method.
  • The user expressly accepts these Terms and Conditions and the Privacy Policy.
  • The user confirms the order and completes payment.
  • The user receives an order confirmation by email, including a summary and reference number.

The sales contract is concluded upon dispatch of the order confirmation by the seller.

4. PRICES

All prices displayed on the website are in euros (€) and include applicable VAT or other taxes as required by law. Shipping costs are shown separately and itemised before the order is confirmed; no hidden charges will apply.

The owner reserves the right to modify prices at any time, without prejudice to orders already confirmed.

5. PAYMENT METHODS

The following payment methods are accepted:

  • Credit/debit card (Visa, Mastercard, American Express) — processed via an SSL-secured payment gateway.
  • PayPal — the amount is charged upon order confirmation.
  • Other methods enabled on the website.

All payments are secure. The owner does not store card data.

6. SHIPPING AND DELIVERY

Orders are shipped via specialist art and antiques transport companies. Professional packaging is used to ensure the integrity of each piece in transit.

  • Estimated delivery times will be provided during the checkout process and may vary depending on the destination.
  • In the event of damage in transit, the buyer must notify the seller in writing within 24 hours of receipt, attaching photographs of both the packaging and the item.
  • Risk of loss or damage to the goods passes to the buyer upon physical delivery.

7. RIGHT OF WITHDRAWAL

In accordance with Article 102 of the TRLGDCU, consumer buyers have the right to withdraw from the purchase within 14 calendar days of receiving the order, without giving any reason and without incurring any penalty.

To exercise this right, the buyer must notify the seller by means of an unequivocal written statement sent to info@palauantiguitats.com or via the withdrawal form available on the website, within the above-mentioned period.

Exceptions to the right of withdrawal (Article 103 TRLGDCU):

  • Goods made to the consumer’s specifications or clearly personalised.
  • Goods liable to deteriorate or expire rapidly.

The buyer must return the item without undue delay, and in any case within 14 calendar days of notifying the withdrawal, in its original condition and packaging. Direct return shipping costs are borne by the buyer, unless the seller agrees otherwise.

The refund will be processed within 14 days of receipt of the returned item, using the same payment method as the original transaction.

8. WARRANTIES AND AUTHENTICITY

All items sold come with a certificate of authenticity issued by Palau Antiguitats S.C.P.. In the event of a well-founded dispute regarding authenticity, the buyer may request an independent expert appraisal. If the lack of authenticity is confirmed, the full cost of such appraisal will be borne by the seller.

The statutory warranty provisions applicable to the sale of goods under Royal Legislative Decree 1/2007 apply, adapted to the nature of second-hand goods and antiques: the statutory warranty period is one year from the date of delivery.

9. ONLINE DISPUTE RESOLUTION (ODR)

Pursuant to Regulation (EU) No 524/2013, consumers may access the European Commission’s Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr

10. GOVERNING LAW AND JURISDICTION

These Terms are governed by Spanish law. Any dispute shall be submitted to the Courts and Tribunals of Barcelona. For consumer buyers, the jurisdiction of their place of domicile is recognised where required under applicable consumer protection law.
